International law guarantees rights to indigenous peoples regarding traditional lands, knowledge, cultural preservation, and human security. This paper will examine the sources of these rights and legal remedies for violations of law. Protection of indigenous peoples’ cultures and resources contribute to the protection of the global environment.

Thanks to the work of Stephen Newmyer, Plutarch’s importance for modern philosophical debates concerning animal rationality and rights has been brought to the forefront. But Newmyer’s important scholarship overlooks Plutarch’s commitment to a range of rational functions that can be ascribed to animals of various sorts throughout the Moralia. Through an application of the ‘spectrum of animal rationality’ described in the treatise On Moral Virtue to the dialogues where his interlocutors explore the rational capacities of non-human animals (especially Whether (...) class='Hi'>Land or Sea Animals are Smarter and Gryllus), this article argues that Plutarch’s commitment to a broad and inclusive sense of ‘reason’ conditions any positive account of animal rationality. Rather, any suggestions of the rational capacities of non-human animals are deeply implicated in Plutarch’s universal system of reason, which differentiates grades of rationality to animals based on natural difference – not unlike his contemporary Stoics. While modern proponents of animal rationality might find some of Plutarch’s ideas unpalatable, the upshot of this study is a fuller sense of Plutarch’s articulate and inclusive sense of reason, which is able to accommodate not only Platonist and Peripatetic notions, but also those of the Stoics and Epicureans, who are especially singled out in the humorous dialogue Gryllus. Thus, Plutarch’s ‘eclecticism’ can be explained as a deep commitment to a universal notion of ‘reason’, marked by a range of functions accessible to all animals – including his philosophical enemies. Sidney Morgenbesser brought to attention cases of the following form: (MC1) Chump tosses an indeterministic coin and, whilst it is in mid-air, calls heads. The coin lands tails, and Chump loses. His betting was causally independent of the coin’s fall. Chump seems right to say: ‘If I had bet tails, I would have won.’1 (MC2).

What we must do is step back and take a grand view of the perspectives in order to understand it on a more particular level. If we can picture all of God’s attributes on a bar graph scale, all of God’s attributes would max out at 100% each. These attributes are always operating at 100%; at no time does any attribute diminish or decrease below 100%. Since the publication of the successful animal trials of the Biobag, a prototypical extrauterine support for extremely premature neonates, numerous ethicists have debated the potential implications of such a device. Some have argued that the Biobag represents a natural evolution of traditional newborn intensive care, while others believe that the Biobag would create a new class of being for the patients housed within. Kingma and Finn argued inBioethicsfor making a categorical distinction between fetuses, newborns and ‘gestatelings’ in a Biobag on (...) the basis of a conceptual distinction between ectogenesis versus ectogestation. Applying their arguments to the clinical realities of newborn intensive care, however, demonstrates the inapplicability of their ideas to the practice of medicine. Here, I present three clinical examples of the difficulty and confusion their argument would create for clinicians and offer a possible remedy: namely, discarding the term ‘artificial womb’ in favour of ‘Biobag’. This is a study of the development of Western inwardness from Plato to Augustine. It traces the origin of three concepts: inward turn, private inner space, and outward expression. All three were originally theological concepts; i.e., they belonged to philosophical theories that related God to the soul. ;Part I examines the precursors of these three concepts in Plato, then notes the central contribution made by Aristotle's doctrine that the mind is identical with the Forms it knows. This allows Plotinus to (...) identify the divine Mind with the intelligible world and locate it within the soul. This then is the foundation of Plotinus' inward turn: in turning its mind into its own interior, the soul is turning to the divine. ;Part II argues that it was Augustine who invented the concept of a private inner space of the self. Augustine's search for God builds on Plotinus' inward turn, but must adjust to the fact that Christian doctrine denies the divinity of the soul. Hence the inner self in Augustine is no longer the intelligible world, but the soul's own inner world. It only becomes a private world, however, inasmuch as the soul is fallen and therefore separated from other souls by the opacity of mortal bodies. (shrink)

Human cognition is said to be systematic: cognitive ability generalizes to structurally related behaviours. The connectionist approach to cognitive theorizing has been strongly criticized for its failure to explain systematicity. Demonstrations of generalization notwithstanding, I show that two widely used networks (feedforward and recurrent) do not support systematicity under the condition of local input/output representations. For a connectionist explanation of systematicity, these results leave two choices, either: (1) develop models capable of systematicity under local input/output representations; or (2) justify the (...) choice of similarity-based (nonlocal) component representations sufficient for systematicity. At root, the systematicity debate over classical versus connectionist explanations for cognitive architecture turns on quantifying the degree to which human cognition is systematic. We introduce into the debate recent psychological data that provides strong support for the purely structure-based generalizations claimed by Fodor and Pylyshyn (1988). We then show, via simulation, that two widely used connectionist models (feedforward and simple recurrent networks) do not capture the same degree of generalization as human subjects. However, we show that this limitation is (...) overcome by tensor networks that support relational processing. (shrink)

In 1947 America’s premier philosopher, educator, and public intellectual John Dewey purportedly lost his last manuscript on modern philosophy in the back of a taxicab. Now, sixty-five years later, Dewey’s fresh and unpretentious take on the history and theory of knowledge is finally available. Editor Phillip Deen has taken on the task of editing Dewey’s unfinished work, carefully compiling the fragments and multiple drafts of each chapter that he discovered in the folders of the Dewey Papers at the Special (...) Collections Research Center at Southern Illinois University Carbondale. He has used Dewey’s last known outline for the manuscript, aiming to create a finished product that faithfully represents Dewey’s original intent. An introduction and editor’s notes by Deen and a foreword by Larry A. Hickman, director of the Center for Dewey Studies, frame this previously lost work. In Unmodern Philosophy and Modern Philosophy, Dewey argues that modern philosophy is anything but; instead, it retains the baggage of outdated and misguided philosophical traditions and dualisms carried forward from Greek and medieval traditions. Drawing on cultural anthropology, Dewey moves past the philosophical themes of the past, instead proposing a functional model of humanity as emotional, inquiring, purposive organisms embedded in a natural and cultural environment. Dewey begins by tracing the problematic history of philosophy, demonstrating how, from the time of the Greeks to the Empiricists and Rationalists, the subject has been mired in the search for immutable absolutes outside human experience and has relied on dualisms between mind and body, theory and practice, and the material and the ideal, ultimately dividing humanity from nature. The result, he posits, is the epistemological problem of how it is possible to have knowledge at all. In the second half of the volume, Dewey roots philosophy in the conflicting beliefs and cultural tensions of the human condition, maintaining that these issues are much more pertinent to philosophy and knowledge than the sharp dichotomies of the past and abstract questions of the body and mind. Ultimately, Dewey argues that the mind is not separate from the world, criticizes the denigration of practice in the name of theory, addresses the dualism between matter and ideals, and questions why the human and the natural were ever separated in philosophy. The result is a deeper understanding of the relationship among the scientific, the moral, and the aesthetic. More than just historically significant in its rediscovery, Unmodern Philosophy and Modern Philosophy provides an intriguing critique of the history of modern thought and a positive account of John Dewey’s naturalized theory of knowing. This volume marks a significant contribution to the history of American thought and finally resolves one of the mysteries of pragmatic philosophy. (shrink)

To properly understand behavior, we must obtain both ultimate and proximate explanations. Put briefly, ultimate explanations are concerned with why a behavior exists, and proximate explanations are concerned with how it works. These two types of explanation are complementary and the distinction is critical to evolutionary explanation. We are concerned that they have become conflated in some areas of the evolutionary literature on human behavior. This article brings attention to these issues. We focus on three specific areas: the evolution of (...) cooperation, transmitted culture, and epigenetics. We do this to avoid confusion and wasted effort—dangers that are particularly acute in interdisciplinary research. Throughout this article, we suggest ways in which misunderstanding may be avoided in the future. (shrink)

The collapse of confidence in anonymization as a robust approach for preserving the privacy of personal data has incited an outpouring of new approaches that aim to fill the resulting trifecta of technical, organizational, and regulatory privacy gaps left in its wake. In the latter category, and in large part due to the growth of Big Data–driven biomedical research, falls a growing chorus of calls for criminal and penal offences to sanction wrongful re-identification of “anonymized” data. This chorus cuts across (...) the fault lines of polarized privacy law scholarship that at times seems to advocate privacy protection at the expense of Big Data research or vice versa. Focusing on Big Data in the context of biomedicine, this article surveys the approaches that criminal or penal law might take toward wrongful re-identification of health data. It contextualizes the strategies within their respective legal regimes as well as in relation to emerging privacy debates focusing on personal data use and data linkage and assesses the relative merit of criminalization. We conclude that this approach suffers from several flaws and that alternative social and legal strategies to deter wrongful re-identification may be preferable. (shrink)

I examine the use of the term function in Aldo Leopold’s land ethic, invoked as (1) the healthy functioning of the land community, which is dependent on (2) the maintenance of the characteristic functions of populations that are parts of the land community. The latter can be understood as referring to interactions between species that are the products of coevolution (such as parasite-host, predator-prey) and, thus, in terms of the “selected effect” account of function. The performance of (...) these functions under certain conditions maintain what Leopold took to be the healthy functioning of a land community. (shrink)

The essays in this volume are by fellow historians of ideas and philosophy, colleagues, and former students of Richard Popkin; its editor is his son, a historian at the University of Kentucky. The volume is in the style of a festschrift, but it has a special personal component. The notes on the contributors indicate how each came to know Popkin. The essays do not concentrate on developments of each author’s own work, but access Popkin’s work, in some instances extending it, (...) and often relating it to aspects of his career. The final contribution is a biographical sketch of his career, done by the editor, from letters that are part of Popkin’s papers housed in the Clark Library at UCLA. This biographical sketch is preceded by a memoir by Avrum Stroll, recounting his collaboration with Popkin on their Philosophy Made Simple, which they co-authored in 1955 and which, in its multiple printings, has served as an introductory textbook for generations of students.The fourteen essays are by B. In this, the first full-length study of Vico's highly original autobiography, Verene discusses its place in the history of autobiography generally, and shows it to be the first work of modern intellectual autobiography which uses a genetic method. The author views the autobiography as a work in which Vico applies the principles of human history discussed in New Science, making the telling of his own life an application and verification of his own philosophy. He places Vico's autobiography within the general (...) development of the genre, considering it in relation to Augustine's Confessions, Descartes's Discourse, and Rousseau's Confessions. The author shows Vico to be not only the founder of the philosophy of history, but also the originator of a philosophical art of self-narrative which is the response by a modern thinker to the ancient problem of self-knowledge. It fills the need for a volume through which Vico's thought can be introduced not just through Vico's major work, the New Science, but through several of Vico's earlier works that lead up to it. These selections are preceded by Pompa's own important book, Vico: A Study of the "New Science".

This is a discussion and translation of the first academic address of Vico’s career. “Delle cene sontuose de’ romani” (“On the sumptuous dinners of the Romans”) was delivered early in 1699 before the Accademia Palatina. This is the same year that Vico assumed his position as professor of Latin eloquence at the University of Naples. Vico’s choice of a topic concerning the details of everyday Roman life derives from his concern to understand Roman culture in terms other than its political (...) history. He approaches the teaching of Latin in a similar way, advocating in his textbook, Institutiones oratoriae, that the place to begin learning Latin is “From the comics!”—meaning that the everyday expressions of Latin speech are those preserved by the comic poets, especially Plautus and Terence. In what ways are Vico and Joyce similar? To what extent is Vico an influence on Joyce? And in what ways can Vico's philosophy be newly understood when seen in relation to Joyce's use of it? This book suggests ways to see both thinkers anew.

At his death in 1945, the influential German philosopher Ernst Cassirer left manuscripts for the fourth and final volume of his magnum opus, _The Philosophy of Symbolic Forms_. John Michael Krois and Donald Phillip Verene have edited these writings and translated them into English for the first time, bringing to completion Cassirer's major treatment of the concept of symbolic form. Ernst Cassirer believed that all the forms of representation that human beings use—language, myth, art, religion, history, science—are symbolic, and (...) the concept of symbolic forms was the basis of his thinking on these subjects. In this volume, which contains one text written in 1928 and another in about 1940, Cassirer presents the metaphysics that is implicit in his epistemology and phenomenology of culture. The earlier text grounds the philosopher's conception of symbolic forms on a notion of human nature that makes a general distinction between Geist and life. In the later text, he discusses Basis Phenomena, an original concept not mentioned in any of his previous works, and he compares his own viewpoint with those of other modern philosophers, notably Bergson and Heidegger.
